Other terrestrial animals

Operators of establishments collecting, producing, processing or storing germinal products shall be registered by the competent authority and assigned with a unique registration number in accordance with Article 93 of Regulation (EU) 2016/429.

I. Germinal products of camelid and cervid animals

Commission Delegated Regulation (EU) 2020/686 provides the following rules and requirements for movements to other Member States of germinal products of camelid and cervid animals:

  • In Article 11 – traceability requirements;
  • in Article 38 - animal health requirements;
  • in Articles 39(3) and 40 – rules concerning animal health certification;
  • in Articles 41, 42 and 43 – rules on notification.

Consignments of germinal products of camelid and cervid animals moved to other Member States should be accompanied by an animal health certificate issued in accordance with model GP-CAM-CER-INTRA set out in Annex I to Commission Implementing Regulation (EU) 2021/403. Use of this model certificate starts on 18 October 2021.

Rules for the entry into the Union of germinal products of camelid and cervid animals have not been harmonised. Such entries should be subject to the general principles of Regulation (EU) 2016/429.

In accordance with Article 234(3) of Regulation (EU) 2016/429, Member States may, following an evaluation of the risks involved, apply national rules, provided that those rules comply with the requirements laid down in paragraph 1 of Article 234 of Regulation (EU) 2016/429 and provided that they take into account the matters referred to in Articles 235 and 236 of that Regulation.

II. Germinal products of terrestrial animals other than bovine, ovine, caprine, porcine and equine animals kept at confined establishments

Commission Delegated Regulation (EU) 2020/686 provides the following rules and requirements for movements to other Member States of germinal products of terrestrial animals other than bovine, ovine, caprine, porcine and equine animals kept in confined establishments:

  • In Article 11 – traceability requirements;
  • in Article 37 - animal health requirements;
  • in Articles 39(2) and 40 – rules concerning animal health certification;
  • in Articles 41, 42 and 43 – rules on notification.

Consignments of germinal products of terrestrial animals other than bovine, ovine, caprine, porcine and equine animals kept at confined establishments moved to other Member States should be accompanied by an animal health certificate issued in accordance with model GP-CONFINED-INTRA set out in Annex I to Commission Implementing Regulation (EU) 2021/403.

Use of this model certificate starts on 18 October 2021.

Until 17 October 2021 an animal health certificate set out in Part 3 of Annex E to Council Directive 92/65/EEC (65 EIII) should be issued for consignments of germinal products in question, as referred to in Article 27(9) of Implementing Regulation (EU) 2021/403.

Rules for the entry into the Union of germinal products of terrestrial animals other than bovine, ovine, caprine, porcine and equine animals kept in confined establishments are laid down in Title 3 of Part III of Commission Delegated Regulation (EU) 2020/692.

Consignments of germinal products of terrestrial animals other than bovine, ovine, caprine, porcine and equine animals kept in confined establishments entering the Union should be accompanied by an animal health certificate issued in accordance with model GP-CONFINED-ENTRY set out in Annex II to Commission Implementing Regulation (EU) 2021/403.

Use of this model certificate starts on 21 August 2021.

Until 20 August 2021 national measures adopted by Member States apply.

III. Germinal products of dogs and cats

Commission Delegated Regulation (EU) 2020/686 provides for traceability requirements in Article 11 for movements to other Member States of germinal products of dogs and cats.

Rules for the entry into the Union of germinal products of dogs and cats have not been harmonised. Such entries should be subject to the general principles of Regulation (EU) 2016/429.

In accordance with Article 234(3) of Regulation (EU) 2016/429, Member States may, following an evaluation of the risks involved, apply national rules, provided that those rules comply with the requirements laid down in paragraph 1 of Article 234 of Regulation (EU) 2016/429 and provided that they take into account the matters referred to in Articles 235 and 236 of that Regulation.

IV. Germinal products for scientific purposes

In accordance with Article 44 of Commission Delegated Regulation (EU) 2020/686, the competent authority of the Member State of origin may grant derogation for the movement to another Member State of germinal products intended for scientific purposes which do not fulfil the animal health requirements provided for in Chapter 1 or 3 of Delegated Regulation (EU) 2020/686, provided the operator of the establishment of dispatch has obtained the prior written consent of the competent authority of the Member State of destination to accept the consignment of germinal products.

Consignments of germinal products moved to other Member States intended for scientific purposes should be accompanied by a self-declaration document issued by the operator based on Article 46 of Delegated Regulation (EU) 2020/686 and that movement should be notified in accordance with Articles 47 and 48 of that Delegated Regulation.

V. Germinal products stored at gene banks

In accordance with Article 45 of Commission Delegated Regulation (EU) 2020/686, the competent authority of the Member State of origin may grant derogations for movements to gene banks in another Member State of germinal products, provided that the operator of the establishment of dispatch has obtained the prior written consent of the competent authority of the Member State of destination to accept the consignment of germinal products collected or produced from :

(a) terrestrial animals belonging to an endangered breed which do not fulfil the animal health requirements provided for in Chapter 1 of Part III of Delegated Regulation (EU) 2020/686; or

(b) terrestrial animals other than bovine, porcine, ovine, caprine and equine animals kept in confined establishments which do not fulfil the animal health requirements provided for in Article 37 of Delegated Regulation (EU) 2020/686.

Consignments of germinal products moved to other Member States for storage in gene banks should be accompanied by a self-declaration document issued by operator based on Article 46 of Delegated Regulation (EU) 2020/686 and that movement should be notified in accordance with Articles 47 and 48 of that Delegated Regulation.

VI. Germinal products of other terrestrial animals

Movement between Member States and entry into the Union of germinal products of other terrestrial animal species are subject to the general principles of Regulation (EU) 2016/429.

In accordance with Article 234(3) of Regulation (EU) 2016/429, Member States may, following an evaluation of the risks involved, apply national rules, provided that those rules comply with the requirements laid down in paragraph 1 of Article 234 of Regulation (EU) 2016/429 and provided that they take into account the matters referred to in Articles 235 and 236 of that Regulation.
