In 2008, the European Commission produced a report on the desirability of special provisions for foods intended for people suffering from diabetes. The report was required by the old legislative framework of Directive 2009/39/EC.

The report concluded that there is no scientific basis on which to produce specific EU legislation covering compositional requirements for this group of foods.

Following the report's conclusions, the European Parliament and Council agreed to exclude foods for diabetics from the scope of Regulation (EU) No 609/2013 on foods for specific groups.
