High risk plants

The Plant Health Law increases the prevention against the introduction of new pests via imports from non-EU countries. Commission Implementing Regulation (EU) 2018/2019 establishes the list of high risk plants the introduction of which into the EU territory will be provisionally prohibited from 14 December 2019 until a full risk assessment has been carried out.

The rules concerning the procedure to be followed in order to carry out the risk assessment of high risk plants are detailed in Commission Implementing Regulation (EU) 2018/2018. In addition, the European Food Safety Authority ('EFSA') has published a technical report on "Information required for dossiers to support demands for import of high risk plants, plant products and other objects as foreseen in Article 42 of Regulation (EU) 2016/2031". EFSA has also produced three webinars to assist non-EU countries in the preparation of their dossiers which can be found on the EFSA website.

Several dossiers have been received from non-EU countries and EFSA has been assessing them. Based on those risk assessments the following Regulations have been published amending the list of high risk plants, plant products and other objects of Regulation (EU) 2018/2019:

  1. Commission Implementing Regulation (EU) 2020/1214 of 21 August 2020 amending Implementing Regulation (EU) 2018/2019 as regards wood of Ulmus L. and certain plants for planting of Albizia julibrissin Durazzini and Robinia pseudoacacia L. originating in Israel
  2. Commission Implementing Regulation (EU) 2020/1361 of 30 September 2020 amending Implementing Regulation (EU) 2018/2019 as regards certain plants for planting of Malus domestica, originating in Serbia and certain plants for planting of Acer japonicum Thunberg, Acer palmatum Thunberg and Acer shirasawanum Koidzumi, originating in New Zealand
  3. Commission Implementing Regulation (EU) 2021/419 of 9 March 2021 amending Implementing Regulation (EU) 2018/2019 as regards certain plants for planting of Jasminum polyanthum Franchet originating in Israel and adapting Combined Nomenclature codes for Ullucus tuberosus and amending Implementing Regulation (EU) 2020/1213 as regards the phytosanitary measures for the introduction of those plants for planting into the Union territory
  4. Certain of the high risk plants are removed from the list, subject to specific phytosanitary measures. Those measures form part of the following EU legislation:

  1. Commission Implementing Regulation (EU) 2020/1213 of 21 August 2020 concerning the phytosanitary measures for the introduction into the Union of certain plants, plant products and other objects which have been removed from the Annex to Implementing Regulation (EU) 2018/2019
  2. Commission Implementing Regulation (EU) 2020/1362 of 30 September 2020 amending Implementing Regulation (EU) 2020/1213 concerning the phytosanitary measures for the introduction into the Union of certain plants for planting of Acer japonicum Thunberg, Acer palmatum Thunberg and Acer shirasawanum Koidzumi, originating in New Zealand
