To ensure the business continuity during the COVID-19 outbreak, any data related to the safety re-evaluation of food additives (e.g. replies to DG SANTE calls for data related to the follow-up on the safety re-evaluation of food additives) should be submitted to the Commission by using the online platform CIRCABC. These measures will remain in place until further notice. No parallel or later submission of the same data in a physical medium (as well as paper copies) is required.

Food additives permitted before 20 January 2009 must go through a new risk assessment by the European Food Safety Authority (EFSA).
Commission Regulation (EU) No 257/2010 set up a programme for the re-evaluation of approved food additives in accordance with Regulation (EC) No 1333/2008.
Regulation (EU) 2019/1381 on the transparency and sustainability of the EU risk assessment in the food chain amended Regulation (EC) No 178/2002 and Regulation 1331/2008 establishing a common authorisation procedure for food additives, food enzymes and food flavourings and is applicable as of 27 March 2021. Commission Regulation (EU) No 257/2010 has been adjusted by Commission Implementing Regulation (EU) 2021/148 in order to provide for levels of transparency and confidentiality that are comparable to those applicable in the context of the procedure for updating the Union list of approved food additives, while taking into account of the specificities of the re-evaluation procedure.

The European Commission has adopted, on 14 January 2022, Regulation (EU) 2022/63withdrawing the authorisation to use a food additive Titanium dioxide (TiO2 also known as E171) in food products.
This measure was endorsed unanimously by the Member States in the context of a Standing Committee on Plants, Animals, Food and Feed.
The Regulation entered into force on 7 February 2022, i.e. on the twentieth day following that of its publication in the Official Journal of the European Union.
E171 used to be added as a colour to a number of foods such as cakes and pastries, confectionary or food supplements.
In order to mitigate the potential impact on food business operators, transitional measures were included in the Regulation allowing to continue placing on the market food containing E 171 for a limited period of time, while food business operators were working on the reformulation of their products.
Therefore, the Regulation allowed, until 7 August 2022, to place on the market foods containing titanium dioxide, in accordance with the conditions given by the legislation applicable before 7 February 2022. Those foods may remain on the market until their date of minimum durability or ‘use by’ date.
Surveillance of the markets is under the competence and responsibility of Member States’ food safety authorities, which will make sure that food containing titanium dioxide is not placed on the EU market anymore.
Products produced and kept in storage for the purpose of sale (i.e. placed on the market*) as finished products (i.e. food which will be as such offered for sale to the final consumer) until 7 August 2022, can continue being sold until their shelf life expires, by any operator, as long as it is not transformed and thus not used for the manufacturing of compound products. Therefore, sales B2B are still possible as long as the product is finished and will not be further transformed along the supply chain.
* "Placing on the market" includes all sales and supplies, including one-off sales, one-off supplies free of charge, and holding food for the purpose of sale. It covers food products which have already been produced by food business operators or imported and are being held with a view to sale or supply free of charge. It does not include food products which are still under processing, or raw materials provided by suppliers.
The Commission prepared its proposal on the basis of a scientific opinion from EFSA, published on 6 May 2021, which concluded that E171 can no longer be considered as safe when used as food additive. This conclusion was reached using all available evidence along with all the uncertainties, in particular the fact that a genotoxicity concern could not be ruled out.
EFSA did not conclude that E171 is genotoxic, but it was not able to establish a maximum Acceptable Daily Intake (ADI) for this food additive, in particular due to possible concerns with respect to genotoxicity, and thus concluded that the safety of the product cannot be confirmed.
Genotoxicity is the ability for a substance or any other toxic agent to damage DNA, the genetic material of cells, which may in turn, as a possible consequence, lead to cancer.
This assessment also took into account new data that were not available when EFSA re-evaluated E 171 in 2016, and made use, for the first time, of the 2018 EFSA Guidance on nanotechnology.
Moreover, EFSA also searched for studies performed specifically with titanium dioxide nanoparticles.
This led to the identification of almost 10.000 different studies, which have been individually screened and, when relevant, taken into account in the safety assessment of E 171.
In line with the applicable legislation and on the basis of the European Medicines Agency (EMA) analysis on the use of titanium dioxide in medicines published 8 October 2021, Regulation (EU) 2022/63 foresees that titanium dioxide remains for the time being on the list of authorised additives to allow its use in medicinal products as a colour. One of the reasons for that decision is to avoid shortages of medicinal products containing the colourant as this could impact public health, animal health and welfare. The replacement of titanium dioxide will also require investigation and testing of suitable alternatives to ensure that quality, safety and efficacy of medicines is not affected negatively.
A review clause is in the Regulation according to which the Commission is to re-evaluate the situation within 3 years after the date of entering into force of the Regulation, on the basis of an updated assessment by the EMA.
This gives a clear sign that the pharmaceutical industry should make any possible efforts to accelerate the research and development of alternatives to replace titanium dioxide in both new and already authorised products, and to submit the necessary changes to the terms of the marketing authorisations concerned.

This call for data is organised by the European Food Safety Authority (EFSA), since the European Commission requested EFSA to address the data gaps identified in the scientific opinion on the re-evaluation of calcium carbonate (E 170) as a food additive, during its upcoming risk assessment of calcium carbonate (E 170) for uses in food for young infants. Therefore, specific data requirements for all uses of calcium carbonate (E 170) are included in this call for data. The call procedures that need to be followed are specified in the text of the call.
Thus, this call shall be regarded as a follow-up of an EFSA re-evaluation scientific opinion, and has therefore the same implications as the calls organised by the European Commission, which are published on this site. Consequently, if business operators do not provide the requested data (by the predefined deadline) the present authorisation of this food additive will be revised based on EFSA’s current scientific opinion and the additive may be removed from the Union list of permitted additives. The same applies if the new data submitted are not sufficient for EFSA to conclude the risk assessment, since there will be no successive calls for additional data.
